Brief description of the Unit

Building upon the introduction to contract law in BULAW1502 Fundamentals of Law and BULAW1503 Commercial Law this course examines detailed formation of contract issues, terms, avoidance, performance, contractual discharge, contract remedies, misleading or deceptive conduct prohibitions and statutory remedies.

Build on the knowledge acquired in BULAW1503 Fundamentals of Law and BULAW503 Commercial Law regarding formation of a contract (terms, conditions and warranties).

Topics may include:

1.The formation of contract

2.The construction of contract;

3.Terms (construction and classification) and exclusion clauses including statutory terms), exclusion clauses, regulation of unfair terms;

4.General law vitiating factors and codification of unconscionable conduct;

5.Contractual discharge; 

6.Misleading or deceptive conduct prohibition;

7.General law contract remedies and statutory remedies.
